Key Points:

  • Definition & Scope: Probate confirms the validity of a Will and appoints Executors. For intestacy (no Will), Letters of Administration apply. Both grant authority to manage the estate.
  • When Probate is Needed: Required for assets in sole names; joint assets typically pass by survivorship. Financial institutions have varying thresholds for requiring Probate.
  • DIY Feasibility: With basic internet and form-filling skills, most people can complete the process online, especially with guidance.
  • Initial Steps: Register the death within 5 days, obtain Death Certificates, and use the “Tell Us Once” service to notify government departments.
  • Estate Valuation: Determine gross, net, and taxable values. Inheritance Tax (IHT) thresholds include £325,000 per person, plus the spouse exemption, and Residence Nil Rate Band.
  • IHT & Probate: IHT must be paid before Probate; interest accrues after 6 months. Payment can be made directly by financial institutions.
  • Application Process: Online application requires details of the deceased, Executors, estate values, and payment of court fees (£300 plus £16 per copy). Original Will must be submitted.
  • Costs: Solicitors often charge £10,000 or more; independent practitioners such as me offer services at significantly lower cost.
  • Post-Probate Duties: Collect assets, settle liabilities, prepare tax returns, make interim and final distributions, and produce estate accounts approved by Executors and beneficiaries.
